HR Legal Updates #1

Working Location of Sponsored Workers – the Home Office has confirmed that hybrid and remote working locations must be reported for sponsored workers. Sponsors should review the work location information recorded for all sponsored workers and make updates on the sponsor management system as appropriate.

IR35 Status Determination Statement (SDS) – an SDS is a written statement which states the employment status of a contractor, i.e. whether the individual is an employee or independent contractor, with reasons to support that conclusion. Don’t worry if you’re confused about where the responsibility lies now – you’re not alone. Plans to scrap the obligations on the end user client were reversed and didn’t happen in April as planned so it’s still the end user client’s responsibility (rather than the contractors).

National Minimum Wage (NMW)
– remember as of last month the increased rates of the national minimum wage (NMW) and national living wage (NLW) now apply. Click here for more information.

If you need more information about any of the changes outlined above or want to discuss implementation in your organisation – for example, updating staff handbooks, contracts, etc please get in touch: info@legaledge.co.uk
